a) The applicants in both the Transfer Applications were initially appointed as Mazdoors (Unskilled) in the Military Engineering Services (MES) between the years 1970 and March/April, 1984 in the pre-revised pay scale of Rs. 196-232, under the command and administrative control of the respondent authorities. b) On the recommendations of the 5th Central Pay Commission, the Government of India introduced the Assured Career Progression Scheme (ACP Scheme) vide Office Memorandum dated 09.08.1999, operative from the same date. c) After the recommendations of the 6th Central Pay Commission, the posts of Unskilled and Semi-Skilled employees were merged into a single cadre in Pay Band-1 with Grade Pay of Rs. 1800 and redesignated as Tradesman Mate. As a result of such merger of pay scales, the promotions and financial up- gradations earlier earned by the applicants under the ACP Scheme became redundant, giving rise to an anomaly. The applicants assert that the merger of pay scales could not nullify the benefits accrued to them under the ACP Scheme, which admittedly continued to remain operative till 31.08.2008. d) The ACP Scheme was replaced by the Modified Assured Career Progression Scheme (MACP Scheme) vide Notification dated 19.05.2009, made operative with effect from 01.09.2008.
The MACP Scheme envisaged three financial up-gradations on completion of 10, 20 and 30 years of regular service in the hierarchy of Grade Pay. Para 9 of the MACP Scheme vested the authority for interpretation and clarification in the Department of Personnel and Training (DoP&T). The DoP&T, vide clarifications dated 16.11.2009 and 09.09.2010, categorically clarified that the ACP Scheme dated 09.08.1999 would continue to apply up to 31.08.2008 and that the MACP Scheme would be applicable only with effect from 01.09.2008. It was further clarified that promotions or financial up-gradations carrying the same Grade Pay after merger of pay scales with effect from 01.01.2006 were to be ignored for the purpose of granting further financial up-gradations.

The applicants served legal notices seeking extension of the same benefits. Earlier Original Applications were disposed of by the Chandigarh Bench of this Tribunal with directions to the competent authority to consider and decide the legal notices by passing reasoned and speaking orders. 3. The respondents have filed their written statement wherein they have averred as follows: -
a) The respondents have filed a detailed counter affidavit opposing the Original Application, raising preliminary objections as well as submissions on merits.
b) At the outset, the respondents have objected to the maintainability of the Original Application, alleging that the applicant has not approached the Tribunal with clean hands and has concealed and suppressed material facts. c) On merits, the respondents submit that the applicant is governed exclusively by the policies, guidelines and instructions issued by the Ministry of Defence through the Engineer-in-Chief's Branch, which alone are applicable to employees of the Military Engineering Services (MES). It is contended that policies or letters issued by other Directorates or establishments under the Ministry of Defence, including the Directorate General of Ordnance Services or Army Ordnance Corps, are not applicable to MES personnel. According to the respondents, establishments such as 1 FOD and 9 FOD fall under the Army Ordnance Corps, which is a separate organization under the Ministry of Defence, and therefore the benefits extended to employees of those establishments cannot be claimed by MES employees as a matter of parity.
d) The respondents have specifically disputed the applicant's claim for grant of 3rd MACP in the Grade Pay of Rs. 2800/- on completion of 30 years of service. Reliance has been placed upon Para 2(c) of the Engineer-in-Chief's Branch letter dated 17.11.2009, wherein it was clarified that employees whose scales were merged into Pay Band-1 with Grade Pay of Rs. 1800/- are entitled to financial upgradations strictly in accordance with the Modified Assured Career Progression Scheme, subject to the applicable conditions.
e) It is further submitted that although certain letters were issued by the Engineer-in-Chief's Branch between 2014 and 2015 granting Grade Pay of Rs. 2800/- as 3rd MACP on completion of 30 years of service, the said letters were subsequently withdrawn and cancelled vide letter dated 11.08.2017.
According to the respondents, once the said letters stood withdrawn, no enforceable right survived in favour of the applicant to claim the benefit of Grade Pay Rs. 2800/-.

g) With regard to the judgments relied upon by the applicant, particularly the decision of the Chandigarh Bench of this Tribunal in Baldev Singh & Ors. vs. Union of India & Ors., it is contended that the said judgment pertains to employees of 09 FOD under the Army Ordnance Corps, which is a separate department under the Ministry of Defence, and hence the said decision cannot be applied to MES employees.
h) It is further submitted that the applicant's representations and legal notices were duly considered and that speaking orders were issued in compliance with the directions of the Chandigarh Bench of this Tribunal. According to the respondents, while issuing the impugned speaking orders, the provisions of the ACP Scheme dated 09.08.1999 and the MACP Scheme applicable after 31.08.2008 were followed in letter and spirit. i) On the aforesaid premises, the respondents have prayed for dismissal of the Original Application, contending that the reliefs sought are contrary to the applicable policy framework and settled administrative instructions governing MES personnel.
4. Heard learned counsel for the parties and perused the pleadings made by them.

Since both the present Original Applications, i.e., OA No. 812/2020 and OA No. 814/2020, raise an identical question of law and facts, challenge similar/identical speaking orders rejecting the claim of applicants, involve the same respondents, and seek parity of financial upgradations under ACP/MACP, these OAs are being disposed of by this common judgment.

7. The broad case set up by the applicants is that the ACP Scheme of 1999 provided two financial upgradations on completion of 12 and 24 years of regular service in the promotional hierarchy; thereafter, the MACP Scheme introduced three financial upgradations, and became operational w.e.f. 01.09.2008. Their grievance is that the respondents have incorrectly treated the merger/placement in a merged pay structure as a promotion/upgradation, and thereby denied the correct upgradation in the promotional hierarchy, leading to fixation at a lower grade pay (such as ₹2000) instead of ₹2400, and consequential denial of ₹2800.
8. It is further pleaded that similarly situated employees have been granted the benefit in other cases and/or pursuant to judicial pronouncements, and therefore denial to the present applicants amounts to arbitrariness, hostile discrimination and violation of Articles 14 and 16 of the Constitution. The applicants have also challenged the impugned speaking orders on the ground that they proceed on a misconception of the ACP/MACP framework and ignore binding clarifications/judicial precedents holding that financial upgradations must be granted in the promotional hierarchy, and that changes due to merger of pay scales/posts are required to be ignored for ACP purposes.
9. The respondents have contested the OAs by filing replies/written statements. It is also pleaded that the applicants have already been granted what is admissible as per respondents' understanding of ACP/MACP, and further benefit would be contrary to policy.
10. The controversy, in our considered view, lies in a narrow compass:
whether the applicants, who completed 24 years of regular service prior to 31.08.2008, are entitled to 2nd ACP in Grade Pay ₹2400 under the ACP Scheme of 1999 (operative till 31.08.2008), and whether on completion of 30 years of regular service they are entitled to 3rd MACP in Grade Pay ₹2800, with consequential benefits; and whether the impugned speaking orders rejecting such entitlement are sustainable.

12. The Chandigarh Bench in the aforesaid judgment also addressed and rejected the core objections which are again being raised before us--
namely, that benefits extended in one organization cannot be extended to another; that absence of financial concurrence defeats entitlement; and that merger of posts/pay scales can be treated as a promotion/upgradation for denying ACP benefit. The ratio emerging is that financial upgradation is to be granted in the promotional hierarchy, and merger/restructuring placements are not to operate as a bar to the rightful ACP benefit when the scheme conditions are otherwise fulfilled. Once a Coordinate Bench has settled the issue on identical facts and law, judicial discipline and consistency require that the same view be followed unless the respondents show a distinguishing feature of substance.
13. In the present matters, the respondents have not been able to point out any material factual distinction which would take these applicants outside the coverage of the Chandigarh Bench judgment. 14. We also find merit in the applicants' contention regarding parity and equal treatment. Where similarly situated employees have been held entitled to the very same benefit by a coordinate Bench and the respondents have not demonstrated any legal impediment such as a stay/reversal by a higher forum, continuing to deny the benefit to the present applicants would amount to unreasonable and discriminatory treatment. Administrative correspondence cannot override the scheme interpretation settled through judicial pronouncement on identical issue.

Therefore, applying the ratio and directions of the CAT Chandigarh Bench judgment (OA No. 306/2022 & connected matters, decided on 31.07.2025), we hold that the applicants in both OA No. 812/2020 and OA No. 814/2020 are entitled to the relief claimed, subject to the same limitations regarding arrears as are ordinarily applied by this Tribunal in such matters.

16. In view of the above, both the OAs i.e., OA No. 812/2020 and OA No. 814/2020 are allowed. The impugned speaking order(s)/rejection order(s) challenged in these OAs are quashed and set aside. The respondents are directed to extend the benefit to each of the applicants (as per their individual service particulars) in terms of the law laid down by the CAT Chandigarh Bench judgment in OA No. 306/2022 & 3 connected OAs, decided on 31.07.2025, by taking the following steps:
(i) Grant 1st ACP in Grade Pay ₹1900 on completion of 12 years of regular service, wherever not already correctly granted;
(ii) Grant 2nd ACP in Grade Pay ₹2400 on completion of 24 years of regular service under the ACP Scheme of 1999, wherever the applicant completed 24 years during the period the ACP Scheme remained operative (up to 31.08.2008);
(iii) Grant 3rd MACP in Grade Pay ₹2800 on completion of 30 years of regular service under the MACP Scheme (w.e.f. 01.09.2008), wherever applicable;

(iv) Refix pay and, wherever applicable, revise pension/retiral benefits and issue consequential PPO revisions, if required;
(v) Release consequential arrears restricted to three years prior to the date of filing of the respective OA as per law laid down by the Hon'ble Supreme Court in case titled "Jai Dev Gupta Vs. State of H.P. and Anr., Civil Appeal No. 3197 of 1991, AIR 1998 SC 2819"
unless a greater benefit is mandated by any binding order applicable to a particular applicant, and thereafter pay ongoing benefits correctly.
17. The above exercise shall be completed and the admissible monetary benefits shall be released within a period of three months from the date of receipt of a certified copy of this order.
18. There shall be no order as to costs.
