03. 1. In the counter affidavit filed by Opposite Party No.3 (State Bank of India), it is acknowledged that there was a genuine mistake made in entering into the correct address of the Petitioner in the account. This prevented the Petitioner from submitting online its FCRA returns and other documents are required by the Foreign Contribution Regulation Rules, 2011 ('FCR Rules').

2. Learned counsel appearing for the State Bank of India states that they have already carried out the necessary rectification in the address reflected in the accounts of the Petitioner.

3. Since the only reason for the Petitioner not being able to upload its details under the FCR Rules was the mistake in the recording of its address in its account, and since that has now been rectified by SBI, it will be open to the Petitioner to resubmit the information/returns and documents in the physical form to the Secretary, Ministry of Home Affairs on the strength of this order.

If such returns/documents are submitted not later than 9th May, 2022 they shall be processed in accordance with law without insisting on the Petitioner having to pay any fine for late submission.

4. The writ petition is disposed of in the above terms. An urgent certified copy of this order be issued as per rules.

5. A copy of this order will be communicated by Shri Parhi, learned Assistant Solicitor General to the Ministry of Home Affairs forthwith.
