Section 33(2) in The M.P. Civil Services (Leave) Rules, 1977
(2)(a)Where a Government servant who is on foreign service in or under any local authority or a corporation or company wholly or substantially owned or controlled by the Government or a body controlled or financed by the Government (hereinafter referred to as the local body) applies for leave preparatory to retirement the decision to grant or refuse leave shall be taken by foreign employer with the concurrence of the lending authority under the State Government.(b)In case the leave is so refused to the Government servant in public interest, it may be availed of by him to the extent admissible under Rule 34 from the date of his retirement.(c)In case the lending authority under Government servant is not agreeable to the refusal of leave preparatory to retirement, it shall be granted to the Government servant and if the foreign employer needs the services of the Government servant during that period, the Government servant may be re-employed by that employer concurrently with leave preparatory to retirement and leave salary regulate in accordance with the provision of Rule 12.
