Pr a hy This is first bail application filed on behalf of the applicant under Section 439 of the Cr.P.C.
ad The applicant is in custody since 28.08.2017, in connection with M Crime No.335/2017 registered at Police Station Bairagarh, District Bhopal (MP) for the offence punishable under Sections 3,4,5 of The of Immoral Traffic (Prevention) Act, 1956.
rt As per prosecution that Roseberry Bar/Spa, situated at Bhopal ou provides various services including massage, on information received from some informant a raid was made then applicant and other co- C accused were found in that Spa surrounded by some women and girls. h ig It is also alleged that some condoms were also found there. Thereafter, case was registered against applicant and other co-accused. H Learned counsel for the applicant contends that applicant is innocent and he has been falsely implicated. He is ready to furnish bail as per the orders abiding with all conditions imposed by the Court. On these grounds, learned counsel for the applicant prays for grant of bail to the applicant.
Per-contra, learned Government Advocate for respondent-State opposes the bail application.
After hearing arguments of the parties and looking to the facts and circumstances of the case, I am of the considered view that at this stage, it would be appropriate to release the applicant on bail, therefore, without commenting on the merits of the case, application of the present applicant namely, Nitesh Sirwani under Section 439 of sh the Cr.P.C. seems to be acceptable. Consequently, it is hereby e allowed. It is directed that applicant be released on bail on his ad furnishing a bail bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety of the same amount to the satisfaction of Pr the JMFC concerned or trial Court for his appearance before them on a the dates given by the concerned Court. It is further directed that the hy applicant shall comply the provisions of Section 437(3) of the Cr.P.C.
