Prayer is for grant of regular bail under Section 439 Cr.PC to the petitioners-accused namely Sunny Kumar and Bittu @ Bindu who are Saalas (brother-in-laws) of the deceased Ravi Kumar, who was found dead in the house of his in laws leading to lodging of case FIR No.121 dated 21.08.2013 for offences punishable under Sections 306 IPC registered with Police Station Rampura District Bathinda, however, during the trial the offences under Sections 302, 149 & 120-B of Indian Penal Code were added vide order dated 28.06.2015 passed by the learned trial Court.
As per allegations the son-Ravi Kumar of the complainant Ramesh Kumar was married to Suman Lata. Out of the said wedlock two children were born. Due to a marital discord between the two, the husband VINAY MAHAJAN 2015.10.30 16:20 I attest to the accuracy and authenticity of this document at Chandigarh CRM-M No.36019 of 2015 #2# Ravi Kumar is alleged to have been killed by the family members of Suman Lata in the house of the in-laws of the deceased. The deceased Ravi had burns through electrocution and as per chemical examiner report "Organo Phosphorous" a poisonous substance was found in his viscera.
It is contended that the deceased Ravi had committed suicide in the house of his in-laws due to a dispute with his wife Suman Lata. It is further contended that their co-accused brother Sikander Singh has since been granted regular bail vide order dated 21.09.2015.
Learned State Counsel on instructions from ASI Sarwan does not dispute the grant of bail to the similarly situated brother Sikander Singh.
Without commenting on the merits of the case, keeping in view the above and parity of treatment, present bail application is allowed and both the petitioners are ordered to be released on bail subject to satisfaction of learned CJM/Duty Magistrate Bathinda.
