This matter was heard on 23.10.2008. Appellant was absent, while the respondents were present through Shri Amrit Singh, Regional Manager & Appellate Authority and Smt. Elsa Catherine George, Administrative Officer & CPIO in response to Commission's hearing notice dated 18.08.2008.
2. After hearing the respondents and perusing the records, it is noted that the same applicant, Shri Hari Om Sharma's exactly similar application / second-appeal (No.CIC/AT/A/2008/00263) was decided through Commission's decision dated 16.07.2008. The respondent in the earlier appeal was The New India Assurance Company Ltd, who, according to the explanation furnished by the respondents in the present case, were involved in the maintenance / financing of the residential project, which is at the centre of some controversy. The earlier decision, therefore, mutatis-mutandis applies to the present case as well.
3. As this matter already stands disposed of through an earlier decision of the Commission, this appeal is not maintainable. Closed.
