Mr. Vikas Pandey, Advocate, present for the
petitioners.
Mr. Chetan Joshi, Advocate has accepted
notice on behalf of respondent No. 1.
Mr. B.D. Pande, Advocate has accepted
notices on behalf of respondent Nos. 2 and 3.
Issue notice to respondent No. 4 returnable
to an early date.
The petitioners are the applicants for the post
of Assistant Professor (Mathematics) in
Government Post Graduate Colleges for which
selection is being conducted by the Uttarakhand
Public Service Commission. However, the degree
which the petitioner possesses is M.Sc. Applied
Mathematics not being allowed to appear in the
examination/interview.
The petitioner contends that he has annexed
the certificate of IIT Roorkee, which shows that
M.Sc. Applied Mathematics is equivalent to M.Sc.
Mathematics.
In view of the above, as an interim measure
the petitioner shall be allowed to appear in the
selection process, which is presently been
conducted by Uttarakhand Public Service
Commission. However, the results of petitioners
shall not be declared and it will be subject to the
final determination of the present writ petition.
The respondents shall file counter affidavits
within three weeks. Thereafter, the petitioners
shall file rejoinder affidavit thereto within three
week.
List this matter after seven weeks in the daily
cause list.
Let a copy of this order be supplied to
learned counsel for the petitioners today itself on
the payment of usual charges.
Accordingly, stay as well as urgency
application is disposed of.
