COMMON ORDER IN APPEAL NOS.2501 TO 2506 OF 2022 BY HON'BLE MR. JUSTICE HULUVADI G. RAMESH, PRESIDENT
01. The Opposite party No.1 had filed these Appeals under section 41 of the Consumer Protection Act challenging the order dated: 21.09.2022 passed in C.C. Nos.77/2016, 78/2016, 12/2017 to 14/2017 & 83/2017 by the District Consumer Disputes Redressal Commission, Koppal.
02. The above Appeals are interconnected to each other as they are arising out of the same cause of action and though complainants are different, opposite party - The National Seeds Corporation is same in all the above Appeals and hence this common order came to be passed.
03. The parties to these Appeals will be referred to as their rank assigned to them by the Commission below.
04. Heard arguments.
05. The District Commission after enquiring into the matters had partly allowed the consumer complaint Nos. 77/2016, 78/2016, 12/2017 to 14/2017 & 83/2017 on 21.09.2022 by directing the OP - The National Seeds Corporation Limited to pay compensation to all the complainants in respect of loss of crop as mentioned in the table and to pay a sum of Rs.3,000/- to each of the complainant towards mental agony and litigation expenses. Further OP is directed to comply the order within 12 weeks from the date of the order failing which the amount ordered carries interest at 6% per annum from the date of order till realization. Aggrieved by these impugned orders, opposite party - The National Seeds Corporation Limited has preferred these above Appeals.
06. Perused the impugned orders and the grounds urged in the above Appeals. The brief facts of the above cases are that, the complainants being the owners of their agricultural lands have purchased Paddy seeds from the Raitha Samparka Kendra to sow the same in their lands. When the crops were grown to certain height complainants found that, there were two different breed of paddy wherein one breed of paddy has come up early and another late. Due to this early grown up paddy was dropped down which resultant to loss of yield to the complainants. Further the complainants alleged that, due to the supply of admixture/inferior breed of paddy seeds supplied by the opposite party - The National Seeds Corporation Limited the complainants have sustained loss of 05 quintals of paddy per acre in the individual capacity. Hence alleging deficiency of service on the part of opposite party - The National Seeds Corporation Limited the complainants have filed consumer complaints before the below Commission.

The common grounds urged by the Appellant in all the above appeals are that, the below commission has failed to consider that, the complainants have not produced any evidence regarding the fertilizers and pesticides used for cultivating the crops. The below commission has also failed to consider that, the complainants have not produced any single sale bill to show that they have sold paddy crops at lesser rates as alleged in the complaint. Without evidence the District Forum had wrongly awarded compensation of Rs.120/- per quintal as against this opposite party and it had also erred in consideration of price list of APMC, Gangavathi, though complainants have not sold their paddy at the APMC Gangavathi. Hence prayed for call for records and to set aside the impugned order passed by the below Commission.

The LC for Respondents/complainants addressed that, the Appellants instead of supplying sona-masuri paddy seeds they have supplied admixture/inferior breed i.e., mixture of other breed paddy seeds and the same came to the knowledge of Respondents only at time of cutting of the crops. The Agriculture University, Raichur, had given report after conducting spot inspection and the same was submitted before the below Commission. After going through the evidence along with supporting documents submitted by both the parties the below Commission had rightly passed the impugned order. But the Appellant with an intention to precipitate the matter and to escape from complying the impugned order had filed these above Appeals which deserves to be dismissed. The report submitted by the Agriculture University, Raichur, clearly goes to show that, there was a mixture of 50% of other seeds as such the below Commission after coming to the conclusion had rightly passed the impugned order and had rightly awarded the compensation along with litigation expenses to the complainants.

In view of the above discussion and the submissions made by the LC for Respondents, we are of the considered opinion that, the below Commission after enquiring the evidence along with documents and report given by the Agriculture University, Raichur, it had rightly passed the impugned order dated: 21.09.2022 in all the above cases and interference of this Commission is not needed. Accordingly the Appeal Nos.2501 to 2506 OF 2022 is hereby dismissed. No order as to costs.
10. The original copy shall be kept in Appeal No.2501/2022 and a true copy thereof shall be kept in Appeal Nos.2502 to 2506/2022.
11. The amount kept in deposit shall be transferred to concerned District Commission for needful.
12. Provide copy of this order to the District Commission as well as to the parties to the above Appeals.
