89. Power of committee and Chairman to impose penalties.
(1)A market committee and its Chairman shall have the power by order to impose the penalties of censure and fine on any market functionary or [seller] [Substituted by Act 35 of 1986 w.e.f.17.6.1986] for contravention of any bye-law after giving the person concerned a reasonable opportunity to be heard:Provided that the market committee shall not be competent to impose fine exceeding [one hundred] [Substituted by Act 35 of 1986 w.e.f.17.6.1986] rupees and the Chairman shall not be competent to impose fine exceeding [twenty-five] [Substituted by Act 35 of 1986 w.e.f.17.6.1986] rupees.(2)An appeal against an order under sub-section (1) shall lie to the [Director of Agricultural Marketing] [Substituted by Act 35 of 1986 w.e.f.17.6.1986] or such officer sub-ordinate to him as he may specify within such period as may be prescribed.
