Heard learned counsels for the petitioner, informant and the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 201 and 302 of the Indian Penal Code.

On recovery of a headless dead body, F.I.R. was recovered against unknown. Subsequently, the dead body was identified as the dead body of Babloo Yadav. Sikandar Mahto confessed guilt when it was suspected that the victim was killed by Sikandar Mahto when dead body was dragged by this petitioner.

It is submitted by learned counsel for the petitioner that except confession of co-accused there is nothing against the petitioner and other accused has been granted regular bail by this Court. It is orally submitted that the petitioner has no criminal antecedent.

This Court sees no reason for the learned court below not to consider the regular bail application of the petitioner if he surrenders within a period of six weeks from the date of receipt of copy of this order in connection with Ballia P.S. Case No. 80 of 2012 pending in the court of the learned C.J.M. Begusarai.

With this observation, the application is disposed off.

Let the order be faxed to the learned court below at the cost of the petitioner.
