This CCC is filed under Sections 11 and 12 of the
Contempt of Courts Act, 1971, by the complainant wherein he
prays that the Hon'ble High Court be pleased to initiate
contempt proceedings for non-compliance of the order passed
by this Court in W.P.No.27736/2016 dated 26.7.2016 vide
Annexure-A.
This CCC coming on for Preliminary Hearing this day,
B.S.PATIL J., delivered the following:-
ORDER
Sri.M.Vasudeva Rao, learned Senior Central Government Standing Counsel undertakes to appear for the respondent - Director, Regional News Unit, Doordarshan Kendra, Bengaluru.
2. We have heard the learned counsel for both parties.
3. Allegation made in this contempt petition is that interim order dated 26.07.2016 passed in the writ petition has been intentionally violated thereby entailing 3 initiation of proceedings under the Contempt of Court Act against the respondent.
4. The interim order passed by the learned Single Judge states that 'as members of the petitioner - Union have been working as stringers for the Regional News Unit, Doordarshan Kendra, Bengaluru for quite some time and as fairly submitted at the bar, there is no threat of removal of these stringers though steps have been initiated for appointing additional stringers, matter is adjourned by two weeks making it clear that members of petitioner - Union who have been engaged as stringers right from 1997 onwards shall not be removed from their assignment without further orders of the Court.'
5. The interim order further made it clear that interim direction issued will not come in the way of additional appointments to be made as stringers. 4
6. Grievance now made by the complainant is that hardly any assignment is given to the members of the complainant - Union and assignment is only given to the new stringers and therefore, there is violation of the direction issued by this Court.
7. This aspect of the matter is disputed by the respondent asserting that assignment has been indeed given to some of the members of the complainant - Union.
8. We do not wish to go into this disputed fact. The matter has to be agitated in the pending writ petition before the learned Single Judge.
9. Suffice to observe that the direction issued is not to remove the members of the complainant - Union from their assignment without further orders of the Court. 5 There is no such removal from their assignment. If no work has been assigned to the members of complainant - Union, it is open for them to bring it to the notice of the learned Single Judge and seek appropriate positive direction.
10. Reserving such liberty, the contempt petition is dismissed.
