By this writ petition, a challenge is made to order passed by the Rajasthan Public Service Commission, Ajmer (for short the RPSC) declaring petitioner to be ineligible for the post of Associate Professor. It was precisely on the ground that petitioner being overage and lacking in required experience. The reply to the writ petition has been filed by the respondents.
It is a case where advertisement was issued by the RPSC on 21.05.2011. The petitioner applied for the post, however, declared ineligible. The maximum age for making application is 50 years whereas petitioner has already crossed the aforesaid age and is not having ten years' experience for the post of Ayurved Chikitsak as the petitioner is having experience of teaching as Kaya Chikitsak.
I have considered the contents of writ petition and find that petitioner is found to be overage as petitioner has attained the age of more than 50 years. The only ground urged regarding age is that the post has been advertised after 20 years.
Looking to overall circumstances, I am of the opinion that petitioner should have made representation to the respondents for consideration of her case by granting relaxation in age and related issue.
Since none is there to press the writ petition, thus it is disposed off with liberty to petitioner to make a detailed representation to the respondents on the issues and if any representation is made, the respondents are directed to consider and decide the same in the light of the judgment in the case of Pawan Kumar Baradiya & Ors. Vs. State of Rajasthan & Anr. in SB Civil Writ Petition No.8046/2008 decided on 18.08.2011 by a speaking order.
This disposes of the stay application also.
