Order (Oral) BY HONBLE MR. JUSTICE S.D. ANAND, MEMBER(J)

1. The applicant herein has applied for the grant of relief which had been claimed by the applicant in O.A. 905/CH/2011 titled Parul Aggarwal & Others vs. U.O.I. & Others, which came to be allowed. The terms of the allowance of the claim came to be noticed in the course of para 19 of the Parul Aggarwals case (supra).

2. At the motion hearing itself, the learned counsel for the applicant relied upon the judgment rendered by this Tribunal in O.A. 905/CH/2011 titled Parul Aggarwal & Others vs. U.O.I. & Others and raised a plea that the controversy herein is squarely covered by that decision. While accepting notice, learned Standing counsel for the Chandigarh Administration, had sought time to have instructions in the context of that averment.

3. On a conjunctive perusal of the judgment in Parul Aggarwals case (supra) and the pleadings in this case, we have no hesitation in noticing the identical nature of relief in that O.A (except that the relief qua the grant of maternity benefit is available only to the married female, applicants herein).

4. Learned counsel for the respondents states that she too is not in a position to contest the governance of this O.A. by the view obtained in Parul Aggarwals case (supra).

5. The O.A. shall stand allowed accordingly in terms of the view obtained in Parul Aggarwals case (supra).

6. The parties shall bear their own costs of the cause in the facts and circumstances of the case.
