ORDER
Per: SURESH KUMAR BATRA MEMBER (J):-
1. In the above captioned 04 Original Applications, the facts, relief claimed and the legal issue involved are similar, therefore, these are being disposed of by a common order, with the consent of learned counsel for the parties. The sole controversy herein is with regard to entitlement of applicants for grant of 2nd ACP on completion of their 12 years of service prior to 31.08.2008 when the ACP Scheme dated 09.08.1999 was still in operation, and further 3rd upgradation under MACP on completion of 30 years of service. For the sake of convenience, the pleadings are extracted from O.A. No. 1033/2021, which is treated as the lead case for adjudication of the instant controversy. The relief claimed is as under:-
(i) That the impugned order dated 30.07.2021 (Annexure A-1), letters dated 11.08.2017 (Annexure A-2), and dated 06.10.2016 (Annexure A-3), be quashed and set aside being wholly illegal and arbitrary.
(ii) That it be declared that the applicants are entitled for 2nd ACP in Grade Pay of Rs. 2400/- under the old ACP Scheme in the hierarchy of posts from completion of 24 years of service, as per similar orders passed in the Ordnance Depots dated 26.04.2017 (Annexure A-12) and 30.07.2018 (Annexure A-13) and also as per law laid down by the C.A.T. Principal Bench in D.S. Rawat v.
UOI & Ors. (OA No. 3038/2013) decided on 11.03.2015, and consequently 3rd MACP in the Grade Pay of Rs. 2800/- on completion of 30 years or 01.09.2008, whichever is later, with all consequential benefits.
2. The summarized facts, as extracted from O.A. No. 1033/2021) are that the applicants initially joined the respondent department as Digitally signed by MAMTA WADHWA Mazdoor (Unskilled) between 1972 and 1980 in the pre-revised pay scale of Rs.196-232 under the control of respondent No.3. Upon implementation of the 4th CPC, they were placed in the scale of Rs.750- 940 w.e.f. 01.01.1986 and thereafter in Rs.2550-3200 w.e.f. 12- O.A. No. 1033/2021 01.01.1996. Under the ACP Scheme dated 09.08.1999 (Annexure A-4), which remained operative up to 31.08.2008, they were granted 1st ACP/promotion in the scale of Rs.2650-4000 and 2nd ACP in Rs.3050- 4590 on completion of 24 years of service. With the implementation of the 6th CPC w.e.f. 01.01.2006, the pre-revised Group „D‟ scales were merged in Pay Band-1 i.e. Rs.5200-20200 with Grade Pay Rs.1800/-, re-designating the post as Tradesman Mate.
3. It is pleaded that due to merger of unskilled and semi-skilled cadres w.e.f. 01.01.2006, the earlier promotions/financial upgradations became redundant in terms of para 5 of the MACP Scheme (Annexure A-
5). DoP&T clarifications dated 16.11.2009 (Annexure A-6) and 09.09.2010 (Annexure A-7) reiterated that ACP benefits were admissible up to 31.08.2008. The Engineer-in-Chief‟s Branch letter dated 12.09.2014 (Annexure A-8) and 30.04.2015 (Annexure A-9) directed grant of 1st ACP in GP Rs.1900 and 2nd ACP in GP Rs.2400 to those completing 12 and 24 years up to 31.08.2008. The applicants, on completion of 30 years of service, were entitled to 3rd MACP in G.P. of Rs.2800/-. The applicants submitted representation dated 27.06.2021 (Annexure A-11), which came to be rejected vide order dated 30.07.2021 (Annexure A-1) relying upon letter dated 06.10.2016 (Annexure A-3), holding that they were entitled only to Grade Pays of Rs.1900, Rs.2000 and Rs.2400 under MACP. Hence, the present OA. Digitally signed 4. The applicants contend that since they completed 24 years of by MAMTA WADHWA regular service prior to 31.08.2008, their case is governed by the ACP Scheme dated 09.08.1999 and not by MACP. In view of merger w.e.f. 01.01.2006, earlier upgradations carrying identical Grade Pay are liable 13- O.A. No. 1033/2021 to be ignored and 2nd ACP must be granted in the promotional hierarchy in GP Rs.2400, followed by 3rd MACP in GP Rs.2800 on completion of 30 years. They place reliance upon the decision of the Principal Bench in D.S. Rawat v. Union of India, affirmed by the Hon‟ble Delhi High Court in Union of India v. K.T. Akhtar, and further on the Chandigarh Bench judgment in Chaman Lal v. Union of India and connected matters, which has been followed by the Jammu Bench in OA No. 812/2020 (CAT Jammu) and OA No. 814/2020 (CAT Jammu).
5. The respondents in their written statement submit that after implementation of the 6th CPC, four pre-revised Group „D‟ pay scales were merged and placed in GP Rs.1800 in PB-1. As per DoP&T O.M. dated 19.05.2009 introducing MACP, financial upgradations are to be granted in the immediate next higher Grade Pay hierarchy and not in promotional hierarchy. According to them, ACP was operative only in pre-revised 5th CPC scales and once the employees opted for revised pay structure under RPR 2008, MACP became applicable.

The respondents further submitted that promotions/upgradations earlier granted in scale Rs.3050-4590 are to be counted and the applicants have correctly been extended MACP in GP Rs.1900, Rs.2000 and Rs.2400. The letter dated 12.09.2014 (Annexure R-1) is stated to be not in consonance with DoP&T policy. The judgment in D.S. Rawat Digitally signed (supra) is sought to be distinguished as relating to different pay scales by MAMTA WADHWA and facts.
7. The applicants have filed a rejoinder, wherein they have reiterated and reaffirmed the averments and contentions raised in the 14- O.A. No. 1033/2021 Original Application, while controverting the pleas taken by the respondents in their written statement. In response thereto, the respondents have filed a additional written statement, maintaining their earlier stand as taken in the written statement and denying the claims of the applicants.

The question that arises for consideration in the present Original Applications is as to whether the applicants, who completed 24 years of regular service prior to 31.08.2008 when the ACP Scheme dated 09.08.1999 was still in operation, are entitled--after ignoring the effect of merger of pay scales w.e.f. 01.01.2006--to be granted 2nd financial upgradation in Grade Pay Rs. 2400/- in the promotional hierarchy under the ACP Scheme, and thereafter 3rd financial upgradation in Grade Pay Rs. 2800/- under the MACP Scheme on completion of 30 years of service, or whether their claim is liable to be regulated only under the Grade Pay hierarchy prescribed in the MACP Scheme as contended by the respondents?
9. We have considered the rival submissions and perused the record. It is not in dispute that the ACP Scheme dated 09.08.1999 remained in operation till 31.08.2008 and that the applicants completed 24 years of service prior to that date. The clarification dated 09.09.2010 (Annexure A-7) specifically provides that financial upgradations under ACP were to be granted till 31.08.2008. The controversy as to whether Digitally signed merger of pay scales w.e.f. 01.01.2006 requires ignoring earlier by MAMTA WADHWA upgradations stands settled.
10. In D.S. Rawat (supra), the Principal Bench of this Tribunal held that once pay scales were merged, earlier promotion carrying identical 15- O.A. No. 1033/2021 Grade Pay had to be ignored and financial upgradation granted in promotional hierarchy. The said view was affirmed by the Hon‟ble Delhi High Court in Union of India vs. K.T. Akhtar (WP(c) NO. 1371/2007 decided on 03.03.2015). The Chandigarh Bench in Chaman Lal Vs. Union of India and Others (O.A. No. 306/2022 decided on 31.07.2025), after considering the entire scheme position, followed the decision of Principal Bench in D.S. Rawat's case (supra) and directed the respondents as follows:-
"(i) Grant 1st ACP in Grade Pay ₹1900 on completion of 12 years of regular service;
(ii) Grant 2nd ACP in Grade Pay ₹2400 on completion of 24 years of regular service under the ACP Scheme of 1999, wherever completed up to 31.08.2008;
(iii) Grant 3rd MACP in Grade Pay ₹2800 on completion of 30 years of regular service under MACP w.e.f. 01.09.2008;
(iv) Refix pay and revise pension/retiral benefits with consequential arrears restricted to three years prior to filing of the OA."
11. Recently, the Jammu Bench in OA Nos. 812/2020 and OA No. 814/2020 titled Sharshti Kumar and Others Vs. Union of India and Others, decided on 02.02.2026, followed the aforesaid ratio and allowed identical relief.
12. The respondents have not shown that the above judgments have Digitally signed by MAMTA WADHWA been stayed or reversed. The issue involved herein is identical, namely entitlement to 2nd ACP in GP Rs.2400 on completion of 24 years prior to 31.08.2008 and thereafter 3rd MACP in GP Rs.2800. Denial of similar 16- O.A. No. 1033/2021 benefit to the present applicants would amount to discriminatory treatment which is not permissible in law.
13. Accordingly, the impugned orders dated 30.07.2021 (Annexure A-1 in O.A. No.1033/2021), dated 14.07.2018 (Annexure A-1 in OA No. 286/2021), dated 19.12.2000 (Annexure A-1 in OA No. 245/2021), letters dated 11.08.2017 (Annexure A-2) and 06.10.2016 (Annexure A-
3) are quashed and set aside to the extent the relevant benefit was denied to the applicants. The respondents are directed to grant 2nd ACP in Grade Pay Rs.2400 on completion of 24 years of regular service under the ACP Scheme wherever completed prior to 31.08.2008, and thereafter 3rd MACP in Grade Pay Rs.2800 on completion of 30 years of service under MACP Scheme w.e.f. 01.09.2008, with consequential refixation of pay and revision of pension/retiral benefits, if applicable. Arrears shall be restricted to three years prior to filing of the OA. The exercise be completed within three months from receipt of certified copy of this order.
All the four OAs stand allowed in the above terms. No order as to costs.
