02. 18.10.2011Heard learned counsel for the petitioner and Mr. Ahsan, learned Assistant Solicitor General for the Respondent- Union of India.
Learned counsel for the petitioner submits that while the petitioner was posted as Constable/Nigh Guard in B.T.P.S. Bokaro, he had performed the duty which would entitle him payment of extra wages/salary. Petitioner has prepared a chart which is enclosed as Annexure-1 indicating his entitlement on account of his having discharged the duty of week/off days and night duty. It is contended that he has been paid for only 30 days for each year.
On perusal of Anneure-1, it appears that the claim pertains to the years 2002-03 and 2003-04. It further appears that a representation in this regard was filed by the petitioner in the year 2004 (Annexure-2) before respondent no.2. Learned counsel for the petitioner submits that the said representation has not been considered and disposed of as yet. 2 Learned counsel for the Respondent-Union of India, on the other hand, submits that petitioner is raising money claim after seven years. Ordinarily, any such claim would be bared by limitation.
Learned counsel for the petitioner submits that petitioner would be satisfied if a liberty is granted to him to file a fresh representation raising his claim and the authorities, in turn, be directed to consider and dispose of the same in accordance with law. If any such representation is filed within a reasonable period of time, the same shall be considered and disposed of in accordance with law.
The application stands disposed of.
