ORAL ORDER
Learned advocate Mr.Parthiv Bhatt requests for some time in the matter. He has submitted that the present applicant was only sleeping partner and he had nothing to do with the Company's affairs. For that purpose, he has relied upon a certificate dated 22.02.2016 (at page no.31).
In response to the aforesaid submission, learned advocate Mr.Akash Singh has submitted that the present applicant is also equally liable for the scam. He has submitted that though the applicant was a sleeping partner, he was having 14,825 shares in his name. It is further submitted that Section 149 sub clause 12 of the Companies Act, 2013 makes him liable for the Company's affairs, even if he is sleeping partner.
The matter is kept on Monday i.e. on 19.07.2021.
The documents supplied by the learned advocate Mr.Akash Singh shall be accepted by the Registry and placed it on the file.
