FACTS

The matter is heard today dated 13.1.2012. Appellant not present but is represented by his brother Shri P. Pandurang Shankar Rao. The Department is represented by Shri M. D. Sheikh, ASP and Shri A. F. Dandge, Inspector. The parties are heard and the records perused.

2. The matter, in short, is that the appellant was GDS-BM in the Department. He worked for about 11 years and then his services were terminated in 2004. It is the allegation of Shri Shankar Rao that his brother's services were terminated capriciously on the basis of bogus documents. On the other hand, Shri Sheikh strongly objects to this allegation and submits that the appellant's services were terminated as he was found to be involved in the embezzlement of Government funds.

3. The Commission cannot go into the merits of the case. The Commission is essentially concerned with the supply of documents requested for by the appellant. Shri Shankar Rao alleges that certain documents have been supplied to him which are bogus and forged. He also alleges that departmental officers earlier mis-guided the CIC due to which the CIC had rejected the appeal.

4. In the facts and circumstances of the case, we deem it expedient to direct the CPIO to give inspection of entire records to the appellant or his representatives and to take extracts there-from, free of cost, on a mutually convenient date and time. The CPIO is directed to give certified copies of documents.

5. This order may be implemented in 04 weeks time.
