Cr.MP No.1915 of 2023 By way of instant application, the applicant/petitioner has prayed for suspension of sentence.
Heard. The substantive sentence imposed by learned Additional Chief Judicial Magistrate, Court No.1, Una,District Una vide judgment of conviction dated 20.12.2022 and order of sentence dated 21.12.2022 in Complaint Case No.203-II-2020, titled as Jugal Kishore Sharma vs. Sukhdev Singh Mankotia and further affirmed by learned Sessions Judge, Una, District Una, H.P. vide judgment dated 01.05.2023 in Criminal Appeal No.12 of 2023, titled Sukhdev Singh Mankotia vs. Jugal Kishore Sharma, shall remain suspended, subject to the applicant's depositing 30% of ::: Downloaded on - 02/06/2023 20:34:07 :::CIS .
compensation amount, if not already deposited, within a period of six weeks and furnishing personal bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial court within the same period r to with condition that the applicant shall appear in Court, as and when directed and shall surrender to serve out the sentence imposed, in case the revision is ultimately dismissed.
Application stands disposed of. Cr.MP No.1916 of 2023 The application is disposed of with a direction to the applicant to file certified copy of judgment of learned Trial Court, within a period of four weeks.
Learned counsel for the petitioner is permitted to produce copy of order downloaded from the High Court website before the concerned authority, who shall not insist for certified copy of the order, however, it may verify the order from the High Court website or otherwise.
