This matter was adjourned at the instance of the respondents including the respondents 7 to 9.
The allegation is construction of a three storeyed building without a sanction plan. Specific allegations have been made that the Basirhat Municipality in collusion with the respondents 7 to 9 has permitted a three storeyed building in gross violation of the law.
This court has no option but to adjourn the matter in view of the resolution of the bar. Although the court is conscious that the respondents are avoiding the court and, thus, the Inspector-in- charge, Basirhat Police Station is directed to forward this order to the Basirhat Municipality so that there is a representation from the municipality with the records of the case before this court on the next date.
Let this matter appear in the list on December 7, 2021 as a 'Fixed Motion' at the top.
2Petitioner is also directed to intimate this order to the respondents and/or their learned advocates. Affidavit of service to be filed on the next date.
Department is directed to send a server copy of this order to the Inspector-in-charge, Basirhat Police Station for onward transmission of the same to the chairperson/board of administrators/ chairman of the Basirhat Municipality.
