                                          ORDER

The Commission has received a complaint petition, dated 11.04.2013(Dy. No. 126642/2013) from Ms Ceejun Chandran, Devli Village, New Delhi stating that she has received no information from the concerned PIO in respect her RTI-application of dated 10.12.2012 filed with PIO/ MCD(South Zone), Green Park, New Delhi. A copy of the complaint and the RTI application are enclosed.

2 In exercise of powers vested under Section 18(1) of the Right to Information (RTI) Act, the Commission directs the Appellate Authority to enquire into the allegations made by the Complainant and after giving him an opportunity of hearing, to pass an appropriate order with a view to ensuring that the desired information is provided to the Complainant, at the earliest.

3. The Appellate Authority is also directed to obtain the explanation of the Concerned persons/officers in writing for not replying in time to the RTI application and to forward the same to the Commission along with his comments within 3 weeks of receipt of the Order to decide on the imposition of penalty on the concerned persons in terms of Section 20(1) of the Right to Information (RTI) Act.

4. In case the Complainant is not satisfied with the orders of the Appellate Authority, he is free to approach this Commission in second appeal.

5. The Complaint is disposed of with the above directions.
