Heard learned counsel for the petitioner and the State.

Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 7 of the Essential Commodities Act. He is P.D.S. dealer. He is sought to be made accused in the instant case as his stock register was recovered from the shop of Gorakhnath Gupta during the raid of his P.D.S. shop.

It is submitted on behalf of the petitioner that his stock register got lost on 31.8.2008 and information to that effect was given to the Block Supply Officer, Uchkagaon under letter dated 2.9.2008, Annexure-3, whereafter another stock register was given to him duly authenticated by the authorities on the basis of which he even withdrew and distributed the stock prior to the lodging of the present case.

Let the petitioner above named surrender in the court below within four weeks from today and thereafter the court below should verify the two facts noted above and if those facts are found true, then he be admitted to the privilege of bail on furnishing bail bond of Rs. 5,000/- (Rs. Five thousand only) with two sureties of the like amount each to the satisfaction of the 2 S.D.J.M., Gopalganj in connection with Mirganj P.S. Case No. 205 of 2008, G.R. No. 2057 of 2008, subject to the conditions, as laid down under Section 438(2) Cr.P.C. Until such verification, no coercive steps be taken against the petitioner.
