The petitioner has filed the present writ petition with a grievance that at
the time of giving appointment to the post of Group - 'C' from the post of Group -
'D', the requisite qualifications as recommended by the Shetty Committee have
not been considered by the respondent authority.
Mr. Prabir Kr. Chowdhury, learned Advocate appearing for the petitioner, submits that the petitioner has been arbitrarily and/or illegally superseded by the private respondent nos. 4 to 7.
Mr. Alok Kr. Ghosh, learned Advocate appearing for the respondent authority, submits that no discrimination has been made at the time of giving promotion to the private respondents. Mr. Ghosh also draws my attention to the gradation list as appears at page - 17 of the affidavit-in-opposition wherefrom it reveals that the persons, who have been given promotion, are appearing much higher than the petitioner's name. The petitioner's name is appearing in Serial No. 56. The private respondent's names are appearing in Serial Nos. 34, 35, 36 and 37. Mr. Ghosh further contends that the petitioner has not been superseded as has been argued by Mr. Chowdhury, learned Advocate appearing for the petitioner.
Considering the submissions advanced by the learned Advocates for the parties and after perusing the records, I am of the view that no relief can be given to the petitioner at this stage when it is admitted fact that the petitioner's name is appearing in Serial No. 56 but upto Serial No. 45 has been given promotion.
Therefore, in my opinion, the petitioner should wait for his turn. Considering the above, in my opinion, there is no illegality and/or informity in the action of the respondent authority which deserves interference by this Court.
Accordingly, the writ petition is dismissed but this order will not preclude the respondent authority to consider the petitioner's case as and when his turn comes.
However, there will be no order as to costs.
Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. ] ( Samapti Chatterjee, J. )
