Section 44(2) in The Maharashtra Raw Cotton (Procurement, Processing and Marketing) Act, 1971
(2)Notwithstanding anything contained in the [Code of Criminal Procedure, 1898] [See now the Code of Criminal Procedure, 1973 (2 of 1974).]-(a)all offences punishable under this Act shall be cognisable and bailable;(b)it shall be lawful for a Presidency Magistrate or Magistrate of the First Class to pass on any person convicted of an offence under sub-section (1) of section 43 a sentence of fine as provided in that sub-section, in excess of his powers under section 32 of the said Code.
