These 47 appeals filed by Sri Umapathi S., the appellant, against the State Bank of India, Bangalore were taken up for hearing on 20.08.2010 through videoconference (VC) facility provided by National Informatics Centre (NIC). Appellant, who was notified to be present at NIC VC facility at Bangalore, was absent. Respondents were present through their Appellate Authority (AA), Ms. Arundhati Bhattacharya.
2. Considering the fact that the number of queries in appellant's 47 RTI applications is over 500, the respondents were asked to submit their position in respect of each query. It is noticed from the respondents' statement that the information relating to the above items is unavailable. It is not clear, however, whether this information was ever present in their records and is now untraceable, or it was never created. If the former is true then, it is to be examined whether these records have been destroyed under the existed retention scheme, or have been found to be untraceable after a proper search, among others. Appeal No. Item of Information Remarks CIC/SM/A/2009/2012 6: C/copy of VVR Voucher Verification Report Denied u/s8(1)(e) for June, 2009--8(1)(e) According to the respondents, the Voucher Verification Report (VVRs) contains personal information of customers of the Bank like names, account numbers, amount of credits/debits, details of transactions etc. These details are held by the Bank in fiduciary capacity. They also referred Section 44 of SBI Act which restricts divulgence of any information relating to the affairs of Banks' constituents to the third party.
Decision:
I am in agreement with the respondents that this variety of information should not be revealed. This is hit by Section 8(1)(j) &(e) of the RTIAct. It is, therefore, directed that there shall be no disclosure in regard to this item of information.
