1. This criminal misc. petition under Section 482 Cr.P.C. has been preferred for quashing FIR No.14/2017 dated 12.01.2017 registered at Police Station, Kotwali, Sri Ganganagar for the offences under Sections 420 and 120B IPC.
2. Learned counsel for the petitioners has the demand draft ready for the amount alleged to have been stopped payment (2 of 2) [CRLMP-1704/2017] in a cheque in the FIR.
3. Learned counsel for the private respondent refused to accept the demand draft, as the mediation proceedings have already failed.
4. Learned Public Prosecutor states that the investigation is complete and the charge-sheet is proposed.
5. Since on the face of it, it cannot be said that the offence is not constituted and the present case is a matrimonial matter, the best could have been a successful mediation, which has already been failed, therefore, this Court has no option but to dismiss the present misc. petition, as the constrained jurisdiction under Section 482 Cr.P.C. does not permit any further indulgence.
6. Consequently, the present misc. petition is dismissed. However, the petitioners shall be at liberty to raise all the issues at the time of framing of charges.
