O R D E R (ORAL)
The facts and issues in both the captioned OAs are since common, the grounds urged on behalf of the parties are also common and the reliefs sought by the applicants are similar. In the background of such admitted position and with the consent of the learned counsel for the parties, the captioned OAs are being heard and decided together by the present common order. However, for the sake of convenience, OA No. 2265/2019 has been treated as a lead case and the facts are being taken from the pleadings therein.

The applicants are aggrieved by order dated 26.10.2015 (Annexure A-1) whereby the respondents have decided to discontinue the grant of Transport Allowance (TA) to them at Delhi rates while posted at Noida and further decided to reduce the TA as well as recover the alleged excess TA paid from January, 2009 to November, 2015 by an order dated 18.07.2019. Aggrieved by the same, they have filed the present O.As. seeking following relief(s):- 24
Item No. 25 (C-4) O.A. No. 2265/2019 With O.A. No. 2477/2019 " (i) That the Hon‟ble Tribunal may graciously be pleased to pass an order of quashing the impugned order dated 26.10.2015 (Annexure A/1) and orders dated 18.07.2019 (Annexure A/2) (colly), declaring to the effect that the whole action of recovering the earlier granted transport allowances at Delhi rates in compliance of Hon‟ble Tribunal judgment during the period from Jan., 2009 to Nov. 2015, is illegal, arbitrary and against the law of the land and consequently, pass an order directing the respondents to refund the same if any recovered with interest.
(ii) Any other relief which the Hon‟ble Tribunal deem fit and proper may also be granted to the applicants with the costs of litigation."

Learned counsel for the applicants takes us through the history and background of the case and states that the respondents passed an order dated 01.08.2012, by virtue of re-classification of 13 cities. The said order was assailed by the applicants in O.A. No. 2080/2012 which was decided on 04.10.2013 wherein the following directions (page 200) had been issued :-
" 6.6 Under these circumstances, we quash the O.M. dated 01.08.2012 and direct the respondent-Ministry of Finance to re-examine the whole issue holistically taking into consideration its history starting from the issue of O.M. dated 03.10.1997, the various directions given by this Tribunal from time to time and the arguments advanced by the applicants in all these OAs mentioned in earlier part of this judgment for grant of special dispensation to satellite towns. This 25 Item No. 25 (C-4) O.A. No. 2265/2019 With O.A. No. 2477/2019 consideration will be done within a period of eight weeks from the date of receipt of a certified copy of this order and the decision will be communicated to the Ministries by means of a reasoned order. We also direct that till such consideration if made and the orders issued by the Ministry of Finance, the employees will continue to draw the TA at the rates at which they have been drawing the same so far and no recovery will be made from them till then. Needless to say that if the applicants are aggrieved by the decision taken by the respondents, they will be at liberty, if they so desire, to challenge the same by means of appropriate judicial proceedings. Accordingly, all these OAs are disposed of. There will be no order as to costs."
4. In pursuance of the first part of the operative portion of the order the respondents after considering the case of the applicants rejected the same by passing an order dated 07.03.2014. This order was once again challenged by the applicants in O.A. No. 996/2014 and batch which was decided on 18.03.2015 wherein the following directions had been issued:-
" 6.5 Thus, we are convinced that our directions as giben I OA 2080/2012 on 04.10.2013 have not been carried out by the respondents and that impugned order dated 07.03.2014 does not constitute full compliance of the same. We, therefore, quash this order and direct the respondents to reconsider the whole issue in accordance with directions given in our order dated 04.10.2013 within a period of eight weeks from the date of receipt of a certified copy of this order. We also direct that till such consideration 26 Item No. 25 (C-4) O.A. No. 2265/2019 With O.A. No. 2477/2019 is made and order issued by the Ministry of Finance, the employees will continue to draw transport allowance at the rates at which they have been drawing the same so far and no recovery would be made from them till then. In case the applicants are still aggrieved by the decision taken by the respondents, they will be at liberty, if so advised, to challenge the same by means of appropriate judicial proceedings. These OAs are accordingly disposed of. There shall be no order as to costs."
5. By virtue of the first part of the operative portion this order, the respondents have once again rejected the claim of the applicants by a fresh order dated 26.10.2015. This order was assailed by similarly placed applicants in a batch of O.A. No. 4663/2015 which was decided on 02.02.2021. The applicants therein assailed the order dated 02.02.2021 before the Hon'ble High Court of Delhi in W.P.(C) No. 8346/2021, wherein the Hon'ble High Court gave the following directions on 12.08.2021:- "CM Nos. 25853/2021
1. Allowed, subject to the petitioners filing legible copies of the annexures before the next date of hearing.
W.P.(C) 8346/2021 & CM No. 25852/2021 [Application filed on behalf of the petitioners seeking stay on recovery towards arrears of transport allowance paid by the respondents] 27 Item No. 25 (C-4) O.A. No. 2265/2019 With O.A. No. 2477/2019

The petitioners claim that, they are being paid transport allowance (TA) at lower rates than Central government employees who are posted in Delhi, by classifying „Noida' in the category of „other places', which, according to the petitioners, is contrary to various Office Memorandums (OMs) issued, in that regard.
3. Mr. S.K. Gupta who appears on behalf of the petitioners, says that, the Central Administrative Tribunal (in short "the Tribunal"), vide order dated 12.01.2016, passed in OA No. 4663/2015, had granted a stay on recovery, which has been vacated by virtue of the impugned order dated 02.02.2021. 3.1. According to Mr. Gupta, the respondents are seeking to recover the differential TA.
4. Issue notice. Mr. Anil Dabas accepts notice on behalf of the respondents. Counter-affidavit will be filed within four weeks from today. Rejoinder thereto, if any, will be filed before the next date of hearing.
5. In the meanwhile, the respondents will maintain status quo, as regards recovery concerning differential TA.
6. List the matter on 24.01.2022.

Learned counsel for the applicants while drawing attention to the prayer clause of the O.A. states that the present O.A. may also be decided in terms of the interim protection given by the Hon'ble High court to the applicants therein. As by way of an order dated 18.07.2019, the respondents have effected recovery for differential TA received by the applicants for the period 2009 to 2015, he 28 Item No. 25 (C-4) O.A. No. 2265/2019 With O.A. No. 2477/2019 prays that the protection extended to the applicants in W.P.(C) No. 8346/2021 may also be extended to the present applicants and the O.A. be disposed of in similar terms.

Learned counsel for the respondents vehemently opposes the same and states that in similar cases the Tribunal had not interfered with and since the subject matter is pending before the Hon'ble High Court, the present O.A. may also be dismissed in terms of the order passed in O.A. 4663/2015 and the applicants should approach the Hon'ble High Court of Delhi to seek the relief.
8. Heard the learned counsel for the parties.
9. The facts recorded above are not in dispute.
10. All that the applicants seek is extension of the protection granted to the applicants in O.A. No. 4663/2015 who are presently agitating their claim in the Hon'ble High Court in W.P.(C) No. 8346/2021. It is not disputed that the present applicants are similarly placed to the applicants in the W.P.(C) No. 8346/2021. I am guided by the said order. 29 Item No. 25 (C-4) O.A. No. 2265/2019 With O.A. No. 2477/2019 Therefore, no purpose would be served in keeping these O.As. pending.

Accordingly, the order dated 18.07.2019 whereby recovery has been effected is being stayed to await the outcome of the W.P.(C) No.8346/2021, which is pending consideration before the Hon'ble High court Of Delhi. Further, it is made clear that the applicants being similarly placed to the applicants in the W.P.(C) No.8346/2021, their fate shall also be subject to the outcome of the decision in the said W.P.(C). Both the parties shall be bound by the decision of the Hon'ble High Court as and when the same is decided. Both the O.A.s are disposed in the above terms. No orders as to costs.
