ORDER
Per: RANJANA SHAHI, JUDICIAL MEMBER
At the request of learned counsels for the parties, OA No.
498/2022, OA No. 497/2022, OA No. 173/2023, OA No.
196/2023, OA No. 189/2023, OA No. 347/2023, OA No.
305/2022 and OA No. 383/2023 are taken up together for
disposal as common question of law and facts is involved in the
aforesaid matters/OAs.
2. For the sake of convenience, brief facts of OA No.
497/2022 (Manish Kumar Meena & Ors. vs. UOI & Ors.) are
taken up. The respondents issued Notification (Annexure A/1)
for engagement of Gramin Dak Sevak (GDS) inviting
applications from the eligible candidates. Clause-5 of aforesaid
Notification "Educational Qualification" reads as below: -

"5. Educational Qualification
Secondary School Examination pass certificate of 10%
standard having passed in Mathematics and English
(having been studied as compulsory or elective subjects) conducted by any recognized Board of School Education by the Government of India / State Governments / Union Territories in India shall be a mandatory educational qualification for all approved categories of GDS."
3. It is the case of the applicants that they had submitted online application form but since in the "Marks/Grade/Point"
column option available was only for "Board of High School and Intermediate Education, Uttar Pradesh, Allahabad" and there being no other available option, the applicants with assistance of Help Desk of Postal Department inquired but was informed that "Board of High School and Intermediate Education, Uttar Pradesh, Allahabad" covered all other Boards, they, therefore, submitted their on-line application by choosing the only available option i.e. "Board of High School and Intermediate Education, Uttar Pradesh, Allahabad". Thereafter, they were called for document verification but during the counselling, it was pointed out that no verification certificate of "Uttar Pradesh State Open School Board, Prayagraj" was obtained. Accordingly, on the same day, the respondents rejected the candidature of the applicants vide impugned rejection letter Annexure A/2 (colly.). The applicants state that some other candidates who qualified from the same Board were given appointment; whereas, the candidature of the applicants was rejected vide Annexure A/2 stating that "selected board name not tallied with uploaded certificate board name". We regret to 18 OA No. 498/2022 & 07 other connected OAs inform you that your application has been cancelled on the above grounds".

In their reply, the respondents have stated that on perusing / cross checking the online form filled by the applicants for the post of GDS with the original documents submitted by them, it was found that the applicants while submitting the online application filled the Board name as "Board of High School and Intermediate Education, Uttar Pradesh, Allahabad" while the mark-sheet and the certificate they presented manually showed the Board name as "Uttar Pradesh State Open School Board"
and hence their candidature was rejected with remarks "selected board name not tallied with uploaded certificate board name"
and being aggrieved of the rightly action taken by the respondents, the applicants filed the present OA. The respondents have also annexed list of State-wise recognized School Education Boards.
5. Heard both sides and perused the documents placed before us.

The applicants assailed the impugned communication (Annexure A/2) whereby their candidature has been rejected on the ground that the name of the selected board by the applicants while submitting on-line application form did not tally with the name of the Board in the certificate uploaded by them. The applicants have stated that since no other option of board 19 OA No. 498/2022 & 07 other connected OAs name except "Board of High School and Intermediate Education, Uttar Pradesh, Allahabad" was available, as such, they had to select the board which was available in the on-line format.
We have examined this matter by keeping aside the issue that the applicants selected a certain board while submitting their on-line applications; whereas, they had uploaded the certificate issued by some other board because there was no other option available, on the ground that the substantive issue should not be lost because of the technical complications in the on-line formatting.
7. The issue which needs to be examined is whether the applicants fulfil the eligibility criteria laid down in the Notification inviting applications for engagement of GDS. In other words, since it is an admitted fact that there was only one option in submitting the online application, the applicants could not have selected the name of the board from which they had qualified.

Now, according to Clause-5 of the aforesaid Notification (reproduced in preceding paras), the candidate must have passed Secondary School Examination of 10% standard in Mathematics and English as compulsory or elective subjects from a Board of School Education, which was recognized by the Government of India / State Governments / Union Territories in India.
20OA No. 498/2022 & 07 other connected OAs The important question is whether as per caluse-5 of the advertisement / notification, the education board from which they passed Senior Secondary Examination was recognized by the Government of India / State Governments / Union Territories. The respondents have categorically stated that the board of education from which the applicants had passed the Secondary School Examination of 10 standard was not recognized Board of Secondary School Education as per the list of recognized Boards of Secondary School Education and to support their contention they have annexed the list of recognized boards of secondary school education issued by the Govt. of India, Ministry of Communications dated 21.01.2022 (Annexure R/4) specifically for "configuration in revised GDS online engagement process". It is pertinent to mention that Annexure-I and Annexure-II of this communication is the list of recognized Board of Secondary School Education by Secretariat, Education(s) Department of State Government and list of recognized School Education Board in India recognized by Ministry of Education, respectively. The name of Uttar Pradesh State Open School Board, Prayagraj from which the applicants have passed the secondary school examination of 10" standard is not listed in the above-mentioned list of recognized boards.

On the other hand, the applicants could not place before us any sustainable document to prove that the Uttar Pradesh State Open School Board, Prayagraj from which they passed Secondary School Education was recognized either by the 21 OA No. 498/2022 & 07 other connected OAs Government of India / State Governments / Union Territories as per the condition, 'clause-5" of the Notification (Annexure A/1) for engagement of GDS issued by the respondents.

Shri Manu Bhargava, learned counsel for the respondents has submitted a judgment dated 12.04.2023 passed by the Hon'ble High Court of Rajasthan, Jaipur Bench in the case of Radheyshyam Meena vs. India Post, Department of Post & Anr. (S.B. Civil Writ Petition No. 18458/2022) regarding the appointment of Gramin Dak Sevak (GDS), which was rejected by the Postal Department on account of not tallying of the name of Board of Secondary Education with the name of Board filled by the petitioner in his online application form. In the aforesaid case, the issue was not even that the Board from which the petitioner had passed out was not recognized. The aforesaid Writ Petition was dismissed by the Hon'ble High Court on the ground that the negligence of the petitioner in filling the online form could not be a ground to direct the authorities to deviate from the advertisement inviting applications or to re-open the selection process. In other words, even the error or act of inadvertence in filling the online application form was held against the applicant; whereas in the present Original Application, the issue was even beyond the discrepancy in filling the online application form, which was that the very Board of Education from which the applicant had passed the Secondary School Examination of 10 standard was not recognized as per 22 OA No. 498/2022 & 07 other connected OAs clause-5 of the Notification inviting applications for engagement to the post of Gramin Dak Sevaks (GDS).
11. In view of the above observations, we do not find it a fit case for interference and, accordingly, the present Original Application (OA No. 497/2022) is hereby dismissed. No order as to costs.
12. In view of the order passed in the aforesaid Original Application (OA No. 497/2022), all the similar/connected Original Applications (OA No. 498/2022, OA No. 173/2023, OA No. 196/2023, OA No. 189/2023, OA No. 347/2023, OA No. 305/2022 and OA No. 383/2023) are hereby dismissed. No order as to costs.
13. In view of the order passed in the OAs, all the pending Misc. Applications, if any, are disposed off.
