Case of the petitioner herein is that he joined the B.Tech Course in 2nd respondent- University and successfully completed his 1st year B.Tech (Food Technology and Science), and thereafter entered into 2nd year of the course. The grievance of the petitioner is that he has been suffering from severe illness because of stones in his kidney and he was advised complete bed rest by doctors and due to such unavoidable medical condition, there was a shortage of attendance in two subjects.

As per the Academic Regulations (R23) of 2nd respondent-University, a student shall be eligible to appear for the University external examinations if he/she acquires a minimum of 40% attendance in each subject, and shortage of attendance below 65% in aggregate shall in no case be condoned.

Admittedly, the petitioner secured 66% aggregate attendance. However, in one of the subjects, his attendance is 39%, falling short of minimum attendance by 1%. The petitioner submitted a representation dated 18.11.2025 to 2nd respondent- University explaining his medical condition and unavoidable circumstances leading to the shortage of attendance.

The petitioner has aggregate of more than 65%. If the petitioner is not permitted to write the examinations, his career would suffer and it would lead to loss of one academic year.

In view of the aforesaid facts and circumstances, this Court is of the opinion that since the petitioner has put up 66% aggregate attendance and fell in shortage of 1% in one of the subjects, the same can be condoned by accepting condonation fee.

Accordingly, the petitioner shall pay the required condonation fee by tomorrow, and 2nd respondent-University is directed to accept the same and permit the petitioner to appear for the remaining examinations.

List the matter after three (3) weeks.
