ORDER
1. From the Writ Petition and the Counter Affidavit it appears that the petitioner, who is an advocate of this Court but is in Naini Jail since 4-12-2000 being main accused in Case Crime No. 439 of 1999 P.S. Naini District Allahabad under Sections 302, 286, 504 & 506 I.P.C., has come up with a number of prayers in this writ petition resorting to his constitutional remedies.
2. His main prayers are:-
i) To quash the Report of the Investigating Officer, C.B.C.I.D.
ii) To get the matter investigated afresh through an independent agency other than C.B.C.I.D., Allahabad Sector.
iii) To command the Respondents to release him on bail for his medical check up and treatment as per advice of the doctors of Sanjay Gandhi Post- Graduate Institute of Medical Sciences, Lucknow as well as report of the doctors from the United States of America.
3. Sri R.P. Yadav, learned counsel appearing on behalf of the petitioner, confines this writ petition only to the relief No.(iii) aforementioned by highlighting that since Article 21 of the Constitution of India guarantees fundamental right to lead a meaningful life to its citizens as well as non-citizens both and the petitioner who is an advocate practicing in this Court, who has been falsely implicated due to enmity and political reivalry in the case in question is hovering between life and death due to liver cirrhosis and thus in the interest of justice keeping the humanitarian aspect of the matter we should permit him to visit United States of America under the supervision of the State at his cost for the purposes of evaluation of his Liver Transplantation as advised by Dr. Ajay Khanna, M.D., Ph.D., F.R.C.S. Asstt. Professor of Surgery of California, San diego (Annexure-4).

On being asked as to whether the Petitioner is prepared to furnish two sureties of Rs. 10 lacs and his affidavit that he will not abuse the privilege and will not attempt to tamper the evidence, which is still going on (as per the information furnished by Sri L.V. Singh, learned A.G.a. to us, who answers that there is no provision for Liver Transplant in the country) he answers in the affirmative.
5. The question as to whether the petitioner has been falsely implicated due to enmity and political rivalry cannot be adjudicated by us at this stage. That is a matter of investigation which is said to be going on. We are also not called upon to express ourselves in regard to the Report already submitted and/or whether the investigation should be directed to be handed over to some other agency since the first two prayers have not been pressed before us.
6. Article 21 of the Constitution of India reads as follows:-
21. Protection of life and personal liberty - No person shall be deprived of his life or personal liberty except according to procedure established by law.
7. We need not make our order bulky by referring to a number of decisions of the Hon'ble Supreme Court clarifying meaning to the word 'life' as mentioned in Article 21 aforementioned and its applicability to Prisoners and Under trials.
8. The Counter does not deny the correctness and authenticity of the advice of the California doctor as contained in Annexure-4. The Counter discloses that the petitioner is being treated at the cost of the State though the petitioner has ventilated some grievance in the manner etc. in regard to his treatment. Article 21 of the Constitution of India, which applies to the Prisoners & Under trials as per the decisions of the Apex Court guarantees a person to lead a meaningful life. In it is also embedded the right of an accused to contest prosecution fairly according to law. If the petitioner dies for lack of proper treatment then how he can fairly contest his prosecution? Even in that event the prosecution will also suffer. Article 21 will be rendered meaningless. From the statements made at the Bar by both learned counsel this much is clear that the Petitioner requires urgently M R Spictroscopy the machine for which is not available and the Liver Transplant Operation is also not possible in our country. Thus, to save his life and give him a fair opportunity to contest the prosecution we direct the State Government to consider his prayer reasonably and sympathetically keeping in mind the constitutional guarantee aforesaid provided the petitioner produces necessary Visa to travel United States of America along with his own affidavit that he will not tamper the evidence already collected so far or influence anyone while collecting further evidence by the Investigating Agency coupled with two sureties to the tune of Rs. 10 lacs each and his preparedness to deposit necessary costs with the State to be borne by it in having supervision on him in this regard latest within a month from today.
9. This writ petition is disposed of accordingly, without cost.
10. Let a copy of this order be handed over to Sri L.V. Singh, learned A.G.A., by Friday dated 22-3-2002 for its intimation to and follow up action by the State Government.
