Leave granted.
In the peculiar facts and circumstances of this case, we are not inclined to disturb the findings of the Courts below with respect to reinstatement. However, at the same time, as the appellant was on probation period and thereafter termination took place as he caused a fatal accident and he was involved in a criminal case also, in which he was acquitted.
In the facts and circumstances of the case, it will be appropriate to confine the back wages instead of Rs.4Lacs to Rs.2.5Lacs. That we order.
Orders are accordingly modified. The appeal is, accordingly, disposed of. Pending application(s), if any, also stand disposed of.
