On the basis of order dated 26.02.2013 passed by a Division Bench of this Court in Writ Petition No. 61176 of 2012 (M/s. Pashupati Castings Ltd. Vs. State of U.P. and Ors.), a clarification was sought for from Hon'ble The Chief Justice as to whether electricity matters involving issues such as electricity duty on fixed charge/demand charge will fall in the category of the matter to be heard by a Division Bench seized with the determination of 'Corporation Matter' or 'Miscellaneous Matters'.
We are informed that a decision has been taken to the effect that these type of cases will come under the category of 'Miscellaneous Matters'.
Therefore, this case be listed before the Bench dealing with 'Miscellaneous Matters'.
