The petitioners seeks permission to confine his prayer to quashing of the order dated 04.08.2008 passed by the Sub-Divisional Magistrate, Sadar, Patna, in case No. 763-M of 2007, by which the Magistrate has refused to drop a 145 Cr. P.C. proceeding.
The petitioners are aggrieved by the order of the Magistrate since he has not considered that in an earlier proceeding under section 145 Cr. P. C. the petitioners have been declared to be in possession of the land, in question, as they were occupancy raiyat.
Since the order is cryptic, the matter is remanded to the Sub-Divisional Magistrate, Patna to pass afresh order in Case No.763-M of 2007. The present order is being passed only on the submission that the case has not proceeded after 04.08.2008.
With the aforesaid observation/direction, the application is disposed of.
