Section 174 in The Maharashtra Municipal Councils, Nagar Panchayats And Industrial Townships Act, 1965

174. Powers to declare any street a public street, subject to objections by owners.

(1)The Council may, at any time, by notice fixed up in any street or part of a street which is not a public street, give intimation of its intention to declare the same to be a public street, and unless within one month next after such notice has been so put up, the owner or if there are more than one owner the owners of the greater portion of such street or of such part of a street lodges or lodge objections thereto at the municipal office, the Council may by notice in writing put in such Street, or such part, declare the same to be a public street.
(2), If such owner or owners object to the proposal under sub-section (1), the Council may, after considering such objections and with the previous sanction of the Collector, declare such street to be a public street, and the owner or owners so objecting shall be entitled to compensation determined in the manner provided in Section 330.
(3)Every such street which becomes a public street under this section shall vest in the Council.
