09/27.09.2019 Heard Mr. A.K. Chaturvedy, learned counsel for the petitioners and Mr. G.S. Prasad, learned A.P.P. for the State.

The petitioners are accused in connection with Patan P.S. Case No. 124/2018.

It has been alleged that the petitioners have committed the murder of the husband of the informant. In course of investigation statement of the witness was recorded at para 7 in which it has been stated that the deceased a few days back had taken the motorcycle of the petitioners which was not been returned. As a result of which a threat was given by the petitioners. The same view has been expressed by the witnesses at para 8 and 9 of the case diary. Para 28 of the case diary contains the statement of Anil Sharma who has stated that there was scuffle and abuse between the petitioners and the deceased and the petitioners had subsequently taken away the motorcycle. Similar is the statement of Ramkesh Yadav at para 29 as well as one of the witness at para 95 of the case diary. The confession of the petitioners have been recorded in para 44 and 45 of the case diary. It therefore appears that on account of the threat meted out to the deceased due to the motorcycle of the petitioner no. 1 being taken away by the deceased and the scuffle which had subsequently ensued resulting in the petitioners taking back the motorcycle they have been implicated for committing the murder of the husband of the informant.

Regard being had to the above, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Palamau in connection with Patan P.S. Case No. 124/2018.
