Section 190(3) in The City of Nagpur Corporation Act, 1948
(3)The remainder of every drain constructed, erected, set up or continued for the sole use and the benefit of any premises shall -(a)vest in the owner of such premises;(b)be maintained and kept in repair by the owner or occupier of such premises; and(c)be from time to time flushed, cleansed and emptied under the orders of the [Commissioner] at the cost of the municipal fund :Provided that, where several premises are drained in common under the last preceding section, such remainder shall vest in the owners jointly and the cost of maintenance and repair thereof shall be distributed in the same proportions as are fixed by the [Standing Committee] under the said section.
