                                       ORDER

1. The Appellant filed an RTI application dated 22.05.2024 seeking information on the following points:

1. Furnish the copy of office circular released for Career Advancement Scheme (CAS) in Puducherry Technological University (PTU) for the period from 01-

01-2022 to till date.

2. Furnish the complete list of candidates (name & designation) applied for Career Advancement Scheme (CAS) from all the departments in Puducherry Page 1 of 4 CIC/UTPON/A/2024/656099 Technological University subsequent to the office circular. File copy may be furnished.

3. Furnish the complete list of candidates (name & designation) of all departments who were applied for promotion through Career Advancement Scheme (CAS) from Assistant Professor stage-1 to Assistant Professor stage-2, Assistant Professor stage-2 to Assistant Professor stage-3, Assistant Professor stage-3 to Associate Professor and Associate Professor to Professor. File copy may be furnished.

4. Furnish the complete list of candidates of all departments who were applied for Career Advancement Scheme (CAS) within the deadline mentioned in the office circular. File copy may be furnished..etc.

2. The CPIO replied vide letter dated 20.06.2024 and the same is reproduced as under

:-

"With reference to your RTI application date 24.05.2024, it is to inform that the case is pending at Chennai High Court for disposal and hence disclosing any information at this juncture will not be appropriate since the case is in subjudice. The reply received from the Convener CAS is closed herewith for your reference."

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 12.08.2024 alleging that the information provided was incomplete, false and misleading. FAA's order, if any, is not available on record.

4. Aggrieved with the non-receipt of the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 16.12.2024.

5. The appellant inter alia submitted that the relevant information has not been provided by the PIO. A written submission dated 25.03.2026 has been received from the Appellant in this regard and same has been taken on record for perusal.

6. The Respondent while defending their case inter alia submitted that the information sought by the Appellant relates to a case which is still pending before the court of law. Furthermore, the concerned file is not available in their office and same is with office of secretary Decision:

The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that the CPIO during hearing stated file related to which information has been sought is not available in their official records. Accordingly, the PIO is directed to furnish a revised reply incorporating the factual status of the matter as submitted during hearing, within four weeks from the date of receipt of this order. A compliance report in this regard be filed with the Commission within a week thereafter. The appeal is disposed of accordingly.

Copy of the decision be provided free of cost to the parties.
