3. The appellant who is arraigned as accused no.2 in FIR No.165 of 2024 registered for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act) is seeking for being enlarged on regular bail.
4. The complainant received information about a person carrying ganja in a bag tied behind him and was traveling in a motorcycle to Raipur side via Odisha and after intercepting the said vehicle and searching the rider Subrat Signature Not Verified Digitally signed by RASHI GUPTA Date: 2026.02.10 18:14:48 IST 1 SLP(CRL.) NO.19857 OF 2025 Reason: Roy, they found eight packets of brown colored powder and found it was ganja weighing 23.680 kgs and said person came to be arrested.

During interrogation, he has stated the names of the people from whom he collected ganja and also stated that the appellant is one of the persons from whom he buys ganja or the appellant being the supplier. On the basis of the said statement, the appellant came to be arrested on 30.12.2024 and has been in custody since that date.
6. Having heard learned counsel appearing for the parties, we notice that other accused person, who stands on the similar footing as that of the appellant, has been enlarged on bail. It is also to be noted that during the pendency of the regular bail application, the appellant was granted an interim bail to perform his daughter’s marriage and immediately after attending the daughter’s marriage he had surrendered before the jurisdictional court.
7. Having regard to the fact that there are no criminal antecedents attributable to the appellant and appellant is 2 SLP(CRL.) NO.19857 OF 2025 apprehended on the basis of the statement of the co-accused, we are of the considered view that appellant is entitled for the relief as sought for.
8. Accordingly, appeal is allowed. Impugned order is set aside. Appellant is ordered to be released on bail on such terms and conditions as the jurisdictional court may deem fit to impose and also on the condition that appellant would appear before the jurisdictional court on all dates of hearing except when exempted for any specific reason.
9. Pending application(s), if any, shall stand disposed of.
