ORDER :The Court made the following order:-
The petitioner, who is arrayed as A9 was arrested on 09/11/2021 and remanded to judicial custody for the offences punishable under sections 420, 465, 468, 471, 120(B) IPC r/w section 66(D) of Information Technology Act, 2020, in Crime No.6 of 2021 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the de-facto complainant Rajendramani was the Managing Director of M/s.Premier Enterprises and he is operating the the companies in Chattarapatti, in the business of spinning, warping, sizing, Airjet looms, machine bleaching, medical fabric manufacturing and exporting. On 08/12/2020, one Laura Jones from America had contacted the de-facto complainant through email stating that he is working in Genomics Bio-science, USA. The company claimed M/s.Laxmi Enterprises Shimal, Himatchal Pradesh was manufacturing Herbal medicines for Cancer. He invited the petitioner to join in the expert and import of the above said business, https://www.mhc.tn.gov.in/judis 3 promising that huge profit can be earned and a memorandum of understanding also signed between the de-fcto complainant and the above said persons. The de-facto complainant sent money of Rs.4.81,58,000/- on various dates through the bank account of M/s.Rajalakshmi Enterprises, Bangalore. After, that the accused told that the sample would be coming to Madurai soon and the Nepal Drug Control Department would have to pay another Rs. 47,41,000/-. So, the this petitioner along with the other accused persons cheated the de-facto complainant.
3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal side) appearing for the respondent.
4.The earlier bail application filed by the petitioner was dismissed by the Principal District & Sessions Judge, Virudhunagar on 01/12/2021. It is seen from the records that the petitioner was arrested 09/11/2021 and ever-since, he is in custody and the major portion of the investigation is also over. https://www.mhc.tn.gov.in/judis 4
5.In view of the above facts and also considering the fact that major portion of the investigation is almost over and duration of the custody of the petitioner, this Court is inclined to grant bail to the petitioner with certain conditions.
6.Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Virudunagar and on further condition that the petitioner shall report before the respondent police once in 15 days at 10.00 am until further orders.
