Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure seeking bail in the case FIR No. 201 dated 09.11.2013, under Sections 354, 354-A, 354-B, 354-C, 323, 506, 148, 149 IPC, Section 3 of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989, Section 66-A of Information Technology Act, 2000 and Section 12 of Protection of Children from Sexual Offences Act, 2012 (later on added 324 of IPC), registered at Police Station Samrala.
Mr. Gurmeet Singh, Advocate has put in appearance on behalf of the complainant and has submitted that the matter has since been compromised. The copy of the compromise was given to the learned State counsel on the last date of hearing.
It has been submitted by the learned counsel for the petitioner that out of 10 accused, 4 have already been allowed bail by this Court. Petitioner was arrested in this case on 09.11.2013.
Keeping in view the fact that the parties have effected compromise, the instant petition is allowed and petitioner is ordered to be released on regular bail on his furnishing bail bond and surety Satyawan bond to the satisfaction of the CJM/Duty Magistrate, Khanna, subject 2014.02.21 16:19 "I attested to the accuracy and integrity of this document"
High Court Chandigarh CRM-M-4690-2014 2 to the following conditions.
(i) He shall comply with the conditions mentioned in Section 437(3) Cr.P.C.
(ii) In the event of his absence on any date of hearing, the benefit of bail allowed to the him shall stand withdrawn.
The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to seek bail afresh.
(iii) He shall not leave the country without the previous permission of the Court.
