ORDER:
Heard learned counsel for the petitioner and Sri Ch. Jagannadha Rao, learned Standing Counsel appearing for the respondent - University.
2. This writ petition is filed seeking a writ of mandamus to declare the action of the respondent - University in not issuing the Degree/Convocation Certificate for U.G. B.Com. (Bachelor of Commerce) Regular (English) pursuant to the petitioner's application in receipt No.BC042200779, dated 11.04.2022, as illegal and arbitrary.
3. This matter earlier came up for consideration on 04.07.2023 and the same was adjourned to enable the learned Standing Counsel appearing for the respondent - University to get instructions in the matter.
4. Sri Ch. Jagannadha Rao, learned Standing Counsel, on instructions, submitted that the petitioner submitted an application, dated 11.04.2023, before the respondent - University for issuance of Degree/ Convocation Certificate. He further submitted that once the Convocation certificate is issued 2 and dispatched, the question of issuing the said certificate once again does not arise. He further submitted that if the petitioner wants a duplicate Convocation certificate, the petitioner should follow a separate procedure as contemplated by the respondent
- University and make an application for issuance of the Degree/Convocation Certificate by filing an affidavit etc. and in case, if the petitioner makes such an application, the same shall be considered by the respondent - University.
5. Learned counsel for the petitioner also expressed willingness that the petitioner would make an application for issuance of duplicate Convocation Certificate by following the procedure and sought indulgence of this Court to direct the respondent - University to consider the said application.
6. In the light of the above, the writ petition is disposed of permitting the petitioner to submit an application for issuance of Degree/Convocation Certificate within a period of two weeks from the date of receipt of a copy of this order and on submission of such application, the respondent - University shall consider the same and issue a duplicate Convocation Certificate subject to the petitioner complying with all the requirements within a further period of four weeks from the date 3 of submission of such application by the petitioner. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
