With the consent of the learned counsel for the parties the matter is heard finally.

The petitioner has filed this petition being aggrieved by the act of the respondents in not fixing his pay and thereafter disbursing the difference in pension pursuant to the orders passed by this Court in W.P No.23687/2003 decided on 23.10.2007 and W.A No.58/2008 decided on 25.1.2008 wherein the orders in respect of declaring the service period of the petitioner as dies non has been set aside.

It is submitted by the learned counsel for the petitioner that inspite of filing representations by the petitioner before the authorities claiming fixation of pay and release of pension, no orders or steps have been taken by the authorities inspite of filing several Contempt Petitions seeking compliance of the orders passed by the Court.

It is observed that inspite of issuance of notice by this Court the respondents have not filed a return till date.

Dr. Satya Prakash Jain vs. State of M.P. & Ors In the circumstances, the petition filed by the petitioner is disposed of with a direction to the respondent no.1 to consider and decide the representations, filed by the petitioner, keeping in mind the orders passed by this Court from time to time expeditiously, in accordance with law, preferably within a period of two months from the date of furnishing a copy of the order passed today alongwith a copy of the petition on the concerned authority, and grant all consequential benefits to the petitioner, if so required.

With the aforesaid direction, the petition filed by the petitioner stands disposed of.
