Date : 23rd December, 2021 The Court: This suit has appeared at the instance of the Department. This suit was appearing in the Warning List and the plaintiff is deemed to have notice that the suit would be taken up today.
None appears on behalf of the parties nor is any accommodation prayed for on their behalf even in the second call.
It appears from the Report filed by the Department that the plaintiff has taken no steps whatsoever to cure or rectify any defects which were pointed out during the scrutiny of the plaint as far back as in 2014. It is evident that the plaintiff has been indolent, lackadaisical and indifferent in pursuing this suit and has adopted a casual approach for a considerable period of time.
In view of the aforesaid, the plaintiff is directed to pay costs of Rs.1 lakh to the West Bengal State Legal Services Authority (SLSA) within a period of two weeks from date as a condition precedent for being permitted to cure the aforesaid defects.

Subject to payment of the costs, the plaintiff will be permitted to cure the aforesaid defects.
Let this suit appear on 21st January, 2022 in order to ensure compliance.
