Facts: 

2.   Appellant by his RTI application had sought information regarding his representation for  granting of prosecution of sanction against Smt. Saroj Bala Sain and Sh. Udhav Singh and  that he had been informed by Sh. Binay Bhushan that his request for granting of prosecution  sanction under the Prevention of Corruption Act and Indian Penal Code has been disposed off.  He wanted the name and designation of competent authority who decided that the request for  sanction to prosecute Smt. Saroj Bala Sain and Sh. Udhav Singh does not merit consideration  and thereby disposed of the case, certified copies of entire file except reply and documents  CIC/SA/A/2015/000772 Page 1 given to him vide which the request for granting prosecution sanction Smt Saroj Bala Sain and  Sh. Udhav Singh has been disposed off.   Having received no information, appellant filed first  appeal. PIO, thereafter, replied on 27.04.2015 stating that the relevant file has been forwarded  to HQ for necessary action.   Hence, this information is not available in the office. FAA by his  order dated 22.05.2015, directed the PIO to provide dispatch number and date of forwarding  file of record to HQ at the request of the appellant.   Being unsatisfied,  appellant approached  the Commission.

DECISION: 

3.       Both   the   parties   made   their   submissions.         The   Commission   having   heard   the  submissions and perused the record, does not find any merit in the appeal and hence rejects  the same.
