1. The present Petitions have been filed under Section 9 of the Arbitration and Conciliation Act, 1996, seeking the following reliefs:-
"(A) Pass an order of injunction restraining the Respondent, its directors, officers, servants and agents from, in any manner whatsoever, transferring, alienating, encumbering, dissipating or otherwise dealing with any monies lying to the credit of or receivable into its Bank of Baroda account No. 30060200000670, Branch Sushant Lok Phase-1, Gurugram, Haryana (SWIFT: BARBINBBGUR), or any other operational bank account of the Respondent; (B) Pass an order directing the Respondent to segregate and earmark, in a separate account or fixed deposit, funds as may be found due upon reconciliation and restraining the Respondent from utilising the same save with the prior written consent of the Petitioner or further orders of this Hon'ble Court.
(C) Pass an order restraining the Respondent from transferring, encumbering, selling, creating charge on its assets, business receivables and contracts which would tend to frustrate or defeat any claim that may lawfully be awarded to the Petitioner;
(D) Pass an order appointing a Local Commissioner or such other fit and proper person as this Hon'ble Court may deem appropriate, with all necessary powers to: (i) inspect the Respondent's stockyards and port plots (including but not limited to Paradip and Goa); (ii) verify and inventory iron ore cargo claimed to be appropriated towards the Petitioner's shipments; and, (iii) secure, copy and/or seal relevant records including stock reports, quality reports, cargo holding certificates and related documentation pertaining to the Petitioner's contracts.
(E) Pass an order directing the Respondent to disclose on affidavit, with supporting documents: - (i) a complete statement of account of all funds received from the Petitioner and/or its affiliates; (ii) all payments made to suppliers and third parties out of such funds; and, (iii) the current status, quantity and location of all cargo procured or purportedly procured against such funds.

2. Learned Senior Counsel appearing on behalf of the Respondent strongly contests the averments made by the Petitioner, in the present Petitions, to the effect that the Respondent is seeking to dissipate its assets, and controverting the said averment submits that there has been no transfer of any of the assets to any other concern by the Respondent.
3. Learned Senior Counsel for the Respondent also submits that the Respondent has duly performed its part of the Agreements, and that only a limited portion of it remains to be performed.

Learned Senior Counsel appearing on behalf of the Petitioner seriously contests this averment, and controverting the same, submits that in at least one of the Agreements, which relates to the Paradip Port, there has been absolutely no performance, and that with respect to the other Agreement relating to the Redi Port, there has only been partial performance of the Agreement.
5. Learned Senior Counsel appearing on behalf of the Petitioner, in fact, submits that this is a clear case of admitted dues which are required to be made good to the Petitioner, and which the Respondent has failed failed to discharge.
6. In this backdrop, learned Senior Counsel appearing on behalf of the Petitioner submits that there is an urgent need to interdict the Respondent from, in any manner, transferring the assets of the Respondent.
7. In view of the foregoing, learned Senior Counsel for the Respondent, in order to controvert the averments made by the This is a digitally signed order.

9. It is made clear that status quo, with respect to all the immovable properties as owned by the Respondent, shall be maintained by the Respondent till the next date of hearing.
10. This Court shall endeavour to take up the matter for final disposal on the next date of hearing.
11. Accordingly, list on 15.04.2026.
