Section 40(2) in The Narcotic Drugs and Psychotropic Substances (Madhya Pradesh) Rules, 1985
(2)If the appeal is admitted the appellate authority may confirm, vary or reverse the decision or order appealed against or may direct such further investigation to be made, as it may think necessary or may remand the case for disposal with such directions as it thinks fit ;Provided that it shall not under this rule vary or reverse any decision or order affecting any right of any private person without having given to such person notice to appear and be heard in support of such decision or order.
