Information sought:
1. The Appellant filed an RTI application dated 05.12.2024(online) seeking the following information:
"I am working as an UDC, ICMR-NIIRNCD, Jodhpur(SC). I have submitted many representation and reminder's to Director, NIINRCD, Jodhpur regarding my application forward to DG, ICMR, New Delhi for consideration his application under LDCE Quota i/o of ICMR Hq. New Delhi Advt. No. 6-2(16)/2024-Estt.CIC/ICOMR/A/2025/613068 Page 1 of 4
Dated 01.10.2024 under reserved category as per the DOPT OM No. No.36011/1/2022-Estt(Res-l) dated 28.03.2024 at NIIRNCD, Jodhpur, but office not replied me in supplied time period. ICMR, New Delhi/NIIRNCD, Jodhpur neglect my representation and going to conduct written examination for the said post on 08.12.2024.
In this regard, Please provide me below mentioned parawise documentary Information:-
I.A certified copy of the roster (Promotion) of the ICMR-NIIRNCD, Jodhpur staff appointed from UDC to Assistant (Level-6) post through promotion/LDCE from 1985 to till date, should be provided.
II.As per the as per DoPT, Gol Guidelines in Promotion reservation roster (Promotion) of the ICMR-NIIRNCD, Jodhpur how many Schedule Cast Category UDC promoted for the post of Assistant (Level-6) post through promotion/LDCE from 1985 till date in should be provided.
III.In Compliance of the DoPT OM No.36011/1/2022-Estt(Res-I) dated 28.03.2024, How many UDC represented for the Promotion for the Assistant Post (Level-6) from 1985 to till date.
IV.Provide me Information regarding every year backlog posts (Assistant Posts) in promotions in NIIRNCD, Jodhpur from 1985 till date should be provided. V.Provide me a certified copy of representation submitted by NIIRNCD, Jodhpur SC's staff for Relaxation of Standards in Departmental Competitive/Qualifying Examinations as per the DoPT, OM No.36011/1/2022-Estt(Res-l) dated 28.03.2024.
VI.As per Department of Personnel and Training O.Μ.Νο.43038/2/3/92- Estt.(SCT), dated the 31 st December, 1992, provide me a certified copy of reservation roster (Promotion) circulated every year for secure proper representation for SC/ST at NIIRNCD, Jodhpur.
VII.In Compliance of the DoPT OM No. 36012/17/88-Estt. (SCT) dated 25/04/1989 How many UDC Promoted for the Assistant Post (Level- 6). VIII.In Compliance of the DoPT OM No. 36011/1/2022-Estt(Res-l) dated 24.03.2024, provide me a certified copy of action taken report for quantifiable data regarding inadequacy of representation of SCs and STS. IX.In Compliance of the DoPT OM No.36011/1/2022-Estt(Res-I) dated 24.03.2024, provide me a certified copy of maintained of reservation roster (Promotion), as per DoPT OM, dated 2.7.1997.CIC/ICOMR/A/2025/613068 Page 2 of 4
X.Provide me certified copies of DPC Minutes for the post of Assistant (Level- 6) as per ICMR Admin. Rules 2017 held before LDCE examination dated 08.12.2024 from each Institutes and ICMR Headquarter, New Delhi. XI.Provide me att recruitment advt. copies under direct recruitment for the post of Assistant (Level-6) by the NIIRNCD, Jodhpur from estd. XII.Provide me information action taken by the NIIRNCD, Jodhpur/ICMR, New Delhi regarding representation made by me vide E-receipts no. 916400 dated 10.10.2024 for consideration my application for the post of Assistant under promotion quota as per DoPT Guidelines.
XIII.Provide me information action taken by the NIIRNCD, Jodhpur/ICMR, New Delhi regarding representation made by me vide E-receipts no. 926389 dated 29.10.2024 (Reminder).
XIV.Provide me information for reservation in Promotion made by the NIIRNCD, Jodhpur in compliance of DOPT OM No.36012/16/2019-Estt. (Res.) dated 12.4.2022 implementing the policy of reservation in promotions. XV.Provide me action taken on my various representation regarding LDCE/Promotion Quota for the post of Assistant (Level-6). XVI.Supply me information that how many UDC's transfer with post from ICMR Hq. and its institutes to NIINRCD, Jodhpur (from 1994 to till date) with post and a list should be provided.
XVII.Supply me information that how many UDC's transfer on temporary post from ICMR Hq. and its institutes to NIINRCD, Jodhpur (from 1994 to till date) without post.
XVIII.Supply me information that how many Assistants transfer/deputed with post from ICMR Hq. and its institutes to NIINRCD Jodhpur (from 1994 to till date) with post and a list should be provided.
XIX.Supply me the details of the pending complaints of ICMR-NIIRNCD officials at National Commission for Schedule Cast.
XX.Supply me the name & designation of ICMR-NIIRNCD erring officials those complaints are pending at National Commission for Schedule Cast."
2. The CPIO furnished a reply to the Appellant on 03.01.2025 stating as under:
"Concerning your application NRNCD/R/E/24/00017 dated 05/12/2024, under the RTI Act 2005, the following information is provided:
The requested information is being processed and will be sent to your email, [email protected], by 15th January 2025."CIC/ICOMR/A/2025/613068 Page 3 of 4
3. Being dissatisfied, the Appellant filed a First Appeal dated 31.01.2025. The FAA vide its order dated 14.03.2025, held as under:
"Please find below the point-wise information regarding Appeal Number NRNCD/A/E/25/00002 Dated 31/01/2025 and RTI REQUEST No. NRNCD/R/E/24/00017 (Mr. Narendar Kumar) Dated: 05/12/2024:
Response to Points No. 1 to 18: These pertain to the ICMR HQ, New Delhi. Response to Points No. 19 and 20: The information cannot be provided under Section 8(1)(e) of the RTI Act, 2005."
4. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerged during Hearing:
The following were present:-
Appellant: Absent.
Respondent: Dr. Ramesh Kumar, CPIO-cum-Scientist 'C', attended the hearing through VC.
5. The Appellant did not participate in the hearing. A withdrawal request has been received from the Appellant vide letter dated 16.04.2026, stating as under:
"Due to personal reasons, I request you to kindly treat my above-mentioned RTI application as withdrawn. I do not wish to pursue the matter further. I would be grateful if you kindly acknowledge the withdrawal of my application."
Decision:
6. In view of the submission made by the Appellant vide letter dated 16.04.2026, the instant Second Appeal is dismissed as withdrawn.
The appeal is dismissed accordingly.
