1. The learned Advocate appearing for the Petitioner states that an attempt was made to serve the Respondent No.1 at the Mumbai address but which was unsuccessful. He further states that service on Respondent No.1 on their Registered office at Germany has been successful. Respondent No.2 is represented by their Advocate.

2. Mr. Sethna, learned Advocate appearing for the Respondent No.2 suggested that this Court may grant leave to the Petitioner to file rectification application which will be considered by the Respondent No.2 within a period of four weeks. The learned Counsel for the Petitioner states that he has no instructions on this suggestion. He applies for notice to be issued to Respondent No.1.
3. Accordingly, the office shall issue notice to Respondent No.1 on their address at Mumbai as shown in the cause title of the Commercial Miscellaneous Petition, returnable on 23rd June, 2023.
