/30.10.2012: Learned counsel for the appellant-applicant states that the name of the widow of deceased Arun Anil Kumar has not been mentioned in the application and he may be permitted to amend the application by incorporating the name of the widow.
Permission, as sought for , is hereby granted. Learned counsel for the appellant-applicant shall carry out necessary correction during course of the day.
(I.A. No. 3179 of 2012) Present interlocutory application has been filed for substitution of the legal heirs of the deceased Respondent No.3, who died during pendency of this first appeal. Appellant-applicant has provided details of the legal heirs and representatives of the deceased Respondent No.3 in para-4 of the interlocutory application.
For the reasons stated in the interlocutory application, same is allowed.
Learned counsel for the appellant-applicant shall carry out necessary amendment in the cause-title of the first appeal, accordingly.
Let notice be issued to the newly added legal heirs and representatives of deceased Respondent No.3, by ordinary process, for which requisites etc. must be filed within two weeks.
Accordingly, I.A. No. 3179 of 2012 stands disposed of. ( First Appeal No. 54 of 2012) Put up this first appeal under the heading "For Admission" on 27th of November, 2012.
Till next date of listing, ad interim order passed earlier shall continue. .
