45. Magistrate' power to impose enhanced penalties.
- Notwithstanding anything contained in section 32 of the Code of Criminal Procedure, 1989, it shall be lawfull for any Court of a Judicial Magistrate of the first class to pass any sentence authorised by this Act in excess of its powers under the said section.
