Petitioners initially appointed as Shiksha Karmis under the provisions of the Madhya Pradesh Janpad Panchayat Shiksha Karmi (Recruitment and Conditions of Service) Rules, 1998. Subsequently, being absorbed as Sahayak Adhyapaks in pursuance to the Madhya Pradesh Adhyapak Samvarg (Employment and Conditions of service) Rules 2008 and granted regular pay-scale with effect from 01.04.2007 seeks direction to the respondents to grant regular pay-scale from the date of their initial appointment as Shiksha Karmi.
During the course of submission, it is being stated by learned counsel for petitioners that similarly situated persons have approached this Court vide writ petition No.602/2010(s) : Mohanlal and ors. v. State of Madhya Pradesh decided on 22.01.2010 & writ petition No.4720/2013 : Jitendra Yadav v. State of Madhya Pradesh and these petitions were disposed of with a liberty to the petitioners to file representation before appropriate Authority and further direction to the appropriate Authority to decide the representation within a period of six months. It is urged that similar direction may be issued in the matter.
2 W.P.No.1064/2014Considering the submission put forth by learned counsel for petitioners and in order to maintain parity, the petition is disposed of with liberty to the petitioners to file representation in respect of the grievance raised in this petition before appropriate Authority within a period of 30 days from today and on receipt of such representation the Authority shall dwell upon the same on merits; decide it and pass a speaking order within a period of six months from the date of receipt of such representation.
It is made clear that this Court has not expressed any opinion on the merits of the matter.
Petition is disposed of finally in above terms.
